Lakeview Clinic, LTD operates the www.lakeviewclinic.com website, which provides information pertaining to the practice.
This page is used to inform website visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our services within the Lakeview Clinic Website.

Notice of Information Security Incident

September 21, 2023 – Lakeview Clinic (“Lakeview”) is issuing notice of a recent event that could potentially affect the security of a limited amount of personal information for certain patients.

 

What Happened?

Lakeview recently conducted an investigation of a security incident involving a now-former employee and the confidentiality of certain patient information maintained by Lakeview. On or about July 26, 2023, Lakeview discovered that this (now former) employee had, without authorization and in violation of Lakeview policy, sent a series of emails from her work email account to her personal email account. This occurred between July 21 and July 24, 2023. This individual had access to a limited amount of patient information as part of her job responsibilities as an employee in Lakeview’s billing department. Some of the emails that were sent included a very limited amount of patient information. As discussed in more detail below, Lakeview immediately terminated this individual (the “Former Employee”) from employment upon learning of her actions.

Based on our investigation, we have determined that the Former Employee’s apparent motive was to try and cause difficulties for Lakeview. At this time, we do not have any knowledge indicating the Former Employee intends to make any malicious use of your personal information or disseminate it further.  Lakeview began notifying the individuals whose information was present in these emails on September 21, 2023.

What Information May Have Been Accessed

Our investigation has discovered that the Former Employee could have potentially accessed the following types of information: first and last names, dates of service, patient sex, the name of the insurance company from which patients have coverage, the amount charged to insurance companies for services that patients’ received at Lakeview and internal Lakeview identification numbers we use to identify patients within our practice. In addition, for a very small number of patients (under 15) some combination of the following data points were also present: dates of birth, a description of the services provided, the balance owed to Lakeview, the name of the treating provider at Lakeview and a billing or procedure code.

There was no credit card information, banking information or medical billing information included in the emails. Nor were home or work addresses, telephone numbers, Social Security Numbers, Drivers’ License Numbers, detailed medical or diagnostic information, provider notes or information about medications, allergies or other sensitive details of patient care included. Again, at this time, we have no evidence suggesting that the Former Employee has done anything with your personal information.

What We Are Doing

We have taken the following steps:

  1. We promptly investigated this matter and came to a conclusion related to the scope and amount of information potentially accessed by the Former Employee.
  2. We terminated the Former Employee from employment with Lakeview. We did this the very same day we discovered this incident (July 26, 2023). When we did that, we specifically instructed her that she needed to return to Lakeview any health information she had in her possession.
  3. We retained outside counsel to assist us in this matter. We sent the Former Employee a letter via certified mail on August 3 and requested again that she confirm in writing that she either has no health information or that she will return all such health information that she does have promptly to Lakeview. The Former Employee responded on August 16 and indicated that she does not have any of Lakeview’s property.
  4. We are reporting this matter to the Office for Civil Rights.
  5. We are engaging in refresher training to remind all Lakeview personnel about the importance of protecting the confidentiality of patient information. This training will include specific reminders that the use of personal computers or personal email accounts to access Lakeview patient information is not permitted under any circumstances. Please understand that there is no indication that any other personnel at Lakeview have engaged in such behavior. We believe this matter to be isolated to the actions of the Former Employee.

What You Can Do to Protect Yourself

Because of the very limited nature of the information involved, we believe there is minimal risk that the information could be misused. However, to help reduce the risk of identity theft, as an ongoing best practice, we recommend carefully and regularly reviewing your credit reports, credit card statements and other financial account information. If you find any unauthorized or suspicious activity, you should contact your credit card company or financial institution immediately. You also should promptly report any fraudulent activity or any suspected incidents of identity theft to proper law enforcement authorities, your state attorney general, and/or the Federal Trade Commission. For your information, a brief Identity Theft Protection Guide, which outlines additional steps that can be taken in the event you have concerns, is posted after the signature below. Again, there was no financial information, Social Security numbers, credit card information or home or work addresses included in the information the Former Employee may have accessed.
